{"id":7706,"date":"2024-08-15T11:06:35","date_gmt":"2024-08-15T11:06:35","guid":{"rendered":"https:\/\/apste.eu\/position_dnsk_property-law-_regime_storage\/"},"modified":"2024-08-15T11:13:20","modified_gmt":"2024-08-15T11:13:20","slug":"position_dnsk_property-law-_regime_storage","status":"publish","type":"post","link":"https:\/\/apste.eu\/en\/position_dnsk_property-law-_regime_storage\/","title":{"rendered":"DNCC Position about the property-law regime of electricity storage facilities"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Regarding questions received about the call for support of new RES capacities and electricity storage, the Ministry of Energy published a <a href=\"https:\/\/www.me.government.bg\/themes\/stanovishte-na-dnsk-vav-vrazka-s-postapili-vaprosi-po-procedurata-za-podkrepa-na-novi-moshtnosti-za-proizvodstvo-na-elektroenergiya-ot-vei-i-sahranenie-na-elektroenergiya-2541-1643.html\" target=\"_blank\" rel=\"noreferrer noopener\">Position of the Directorate for National Construction Control (DNCC) on the property-law regime of electricity storage batteries<\/a>. The position states that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>in cases where batteries are installed in existing buildings\/facilities for the producer\u2019s or end customer\u2019s own consumption, which do not supply energy to the grid, it is not necessary to be issued a building or placement permit.<\/li>\n\n\n\n<li>When the battery does not fall under the preceding hypothesis, but is a facility within the electricity system, it is considered as a movable object within the meaning of the Spatial Planning Act (SPA).<\/li>\n\n\n\n<li>In case the batteries are located in containers, the containers constitute a movable object and should be installed with a placement permit issued by the chief architect of the municipality, in accordance with the procedure and under the conditions of Article 56 of the SPA.<\/li>\n\n\n\n<li>When mobile battery containers are installed on solid reinforced concrete foundations, a separate building permit shall be issued for the foundations.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>>> Read the full text of the Position of the DNCC on the property regime of batteries <\/em><a href=\"https:\/\/www.me.government.bg\/uploads\/manager\/source\/VOP\/%5BUntitled%5D.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>here<\/em><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Regarding questions received about the call for support of new RES capacities and electricity storage, the Ministry of Energy published a Position of the Directorate for National Construction Control (DNCC) on the property-law regime of electricity storage batteries.
