While the proposal to transition to an open registration regime was rejected, substantial facilitations were introduced for the entry of new recovery organisations, along with a reduction in required bank guarantees and mechanisms to curb monopolistic markups on product fees (eco-fees).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Producer responsibility organisations are required to submit annually by 31 March to the Ministry of Environment and Water (MOEW) their fee calculation methodology, relevant contracts, and justifications for fee adjustments. MOEW will publish this information publicly by 15 April. Any upcoming fee increase must be communicated to members and the Ministry at least 3 months in advance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Act stipulates that the fees paid by equipment manufacturers and importers must not exceed the actual, necessary costs for collection, transport, pre-treatment, and recycling. A statutory requirement is introduced mandating that revenues generated from reuse and the sale of valuable secondary raw materials must be deducted from the cost base.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Product fees payable to Enterprise for Management of Environmental Protection Activities (EMEPA \/ PUDOOS) are to be determined strictly on a cost-oriented basis by the Council of Ministers, and the collected funds will be disbursed by the Enterprise exclusively against verifiably documented recycling and treatment outcomes. The objective is for the public fee to serve as a ceiling, preventing cartel-driven fee inflation by private collective systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Viable Alternative and Competition &#8211; up to now, high bank guarantees and minimum population coverage thresholds entrenched the monopolistic position of incumbent organisations.
