The amendments require grid operators to ensure full public transparency not only regarding current available capacity, but also on planned grid capacity expansions and projected commissioning timelines. The objective is to provide visibility over actual &#8220;residual capacity&#8221;, including factoring in permits issued for projects that have not yet been commissioned. Electronic tracking of administrative files for grid connection and clearance of RES projects is also introduced, enabling developers to monitor application progress and statutory deadlines in real time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A key legal and technical adjustment was made concerning installations up to 30 kW. Because they fall under Category VI under the Spatial Development Act (SDA) and are not subject to a formal commissioning certificate (permission to use), the signing of the statement of compliance under the grid connection agreement was established as the governing criterion. This unifies the regulatory treatment of all small rooftop and ground-mounted systems. The right to enter into new preferential feed-in tariff agreements for systems up to 30 kW is abolished upon the entry into force of the Act, while existing contracts executed prior to that date maintain their current terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All RES generators operating purely on the open market without state subsidies and commissioned after 1 January 2021 are exempt from the mandatory 5% revenue contribution to the Security of the Electricity System Fund (SESF). The 5% contribution remains mandatory only for plants receiving state support via the Fund (such as those under contracts for premium or installations up to 30 kW with preferential feed-in tariffs under Art. 31 of EREMA concluded prior to the amendments).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The procedure has also been defined for instances where a generator (photovoltaic, wind, or small hydro under a long-term contract) exceeds its net specific generation cap and remains within the balance group of the supplier of last resort \/ default supplier. Such surplus volumes will be off-taken at the volume-weighted average monthly exchange price corresponding to the generator&#8217;s technology-specific generation profile (minus administrative expenses), replacing the obsolete imbalance settlement price for energy shortage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A statutory obligation is established to assess regulatory and administrative obstacles to corporate renewable power purchase agreements (PPAs), assigning responsibility for this market monitoring and analysis to EWRC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Committee firmly rejected a proposal by &#8220;Vazrazhdane&#8221; to postpone the entry into force of the Act by three years pending the introduction of new sanitary setbacks and health distance requirements (aimed primarily at restricting onshore wind farms).
