Reduced Eco-Fees for Appliances and Solar Panels Halted by Court

Following an appeal by producer responsibility organisations against the reduced product fees for electrical appliances and solar panels, on 6 October 2026 the Supreme Administrative Court (SAC) ruled to suspend the entry into force of the reduced fee rates adopted a month earlier.

The appellants argue that the Ministry of Environment and Water (MOEW) failed to conduct an adequate and objective preliminary assessment of how this drastic reduction would impact the collection and recycling system for household hazardous waste over the long term. Their concerns are that revenues generated from the reduced fees will be insufficient to cover contractual obligations toward subcontractors, which are pegged to a percentage of the statutory public fee. According to the organisations, this creates a tangible risk of payment defaults to operators, disruptions to waste collection operations, and failure to meet national recycling and environmental targets.

The ruling has subsequently been appealed by the Council of Ministers, with the next court hearing before the Supreme Administrative Court scheduled for 10 February 2027.
