In issue 16 from 23.02.2024 of SG the Law amending and supplementing the Energy Act, which introduces a new procedure for changing the use of agricultural land when it is necessary to build renewable energy production facilities, was promulgated. According to the new texts the change of the designation of agricultural land will be carried out after the entry into force of a Detailed Development Plan (DDP) providing for the construction of a renewable energy production facility and the issuance of a certificate by the Minister of Agriculture.
The amended bill seeks to make the change of land use conditional on the entry into force of the land use plan (DDP), until the objectives set out in the Integrated Energy and Climate Plan of the Republic of Bulgaria (NPEC) are reached. It also introduces a requirement for an opinion issued by the Minister of Energy to establish the necessity of the construction of each investment project to achieve the national target in the NPEC. According to the current NPEC, Bulgaria’s targets for the period 2020-2030 are to install 3216 MW of PV and 948 MW of wind PP.
